Abstract

This article examines the legal framework governing water law in the Democratic Republic of the Congo (DRC) and the geopolitical issues surrounding the Congo Basin. It shows that the right to water is recognized as a fundamental right under Articles 48 and 9 of the Constitution of 18 February 2006, as amended in 2011, and is implemented through Law No. 15/026 of 31 December 2015 on water, which is based on the principles of Integrated Water Resources Management (IWRM). The study also highlights that the Congo Basin is a globally strategic area whose water resources generate both opportunities for regional cooperation and geopolitical tensions, particularly regarding the Transaqua project, which aims to transfer part of the Congo Basin’s waters to Lake Chad. It concludes that the effective protection of the right to water, the preservation of the DRC’s water sovereignty, and the strengthening of regional cooperation are essential conditions for the sustainable management of this strategic resource.
